Why Can’t Your 2022 Tax Return be Filed Claiming a Hurricane Ian Loss?

Florida Taxpayers are Still Waiting on Congress to Act

As this month marks the official start of the 2023 hurricane season, we are reminded of the lingering impact Hurricane Ian has had on our community.  Florida legislators have introduced bills to “fix” the status of Hurricane Ian so that losses can be claimed as “qualified disaster losses”. Currently, the bills most likely to get traction are the senate and house versions of The Hurricane Tax Relief Act of 2023. Links to the bills are noted below.

S.764 – 118th Congress (2023-2024): Hurricane Tax Relief Act | Congress.gov | Library of Congress

H.R.1494 – 118th Congress (2023-2024): Hurricane Tax Relief Act | Congress.gov | Library of Congress

This legislation was introduced back in March and there is still no progression through the respective committees, although we do anticipate that relief will be forthcoming.  HSC is continuing to proactively track this legislation. Representative Byron Donalds’ staff reassured us that “his team is activity working with the committee to push his house version through as quickly as possible so it can be easily merged with the senate version”.  We are also continuing to reach out to Senator Rick Scott’s office for updates on migration of the senate bill.  We encourage you to share your concerns with these legislators as well by contacting Rep. Byron Donalds at (239) 599-6033 and Sen. Rick Scott at (202) 224-5274.

We at HSC will continue our efforts and keep you informed of any developments.  With the debt ceiling matters settled, we anticipate that the priority of Florida lawmakers will shift back to getting this much needed disaster relief passed for the communities they serve.  We will provide further updates as we inch closer to the fall deadlines.
